FAN SUBMISSION TERMS & PRIVACY CONSENT

Effective Date: June 2, 2026

Thank you for sharing your memories with us! By submitting, uploading, or transferring any photo, video, audio recording, or other media ("Submission") taken at our tour dates or events to The Arcadian Wild or Arcadian Wild LLC (collectively, "we," "us," or "our"), you agree to be bound by these Fan Submission Terms & Privacy Consent (the "Agreement").

If you do not agree to these terms, please do not upload or send us your media.

1. License and Right to Use Your Submissions

By sending us your Submission, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, fully sub-licensable, and transferable license to use, reproduce, distribute, prepare derivative works of, display, perform, edit, crop, remix, overlay with audio, and otherwise exploit your Submission.

  • This includes the right to post your Submission on our official social media channels (including but not limited to Instagram, TikTok, YouTube, and Facebook), our website, our email newsletters, and in any promotional material or future commercial releases (e.g., music videos, tour documentaries, or marketing campaigns).

  • You waive any "moral rights" or rights of attribution you may have in the Submission.

2. Intellectual Property & Ownership

You retain ownership of the copyright in your original Submission. However, you explicitly agree that you will receive no financial compensation, royalties, or credit of any kind for our use of your Submission.

3. Your Representations and Warranties

By uploading or providing the Submission, you represent and warrant that:

  1. Age of Consent: You are at least 18 years of age (or the legal age of majority in your jurisdiction) and have the full legal right and authority to enter into this Agreement.

  2. Original Work & Clearances: The Submission is your own original work. You own or control all necessary rights to the Submission.

  3. No Third-Party Infringement: The Submission does not infringe upon the copyrights, trademarks, rights of privacy, rights of publicity, or any other intellectual property rights of any third party. If other people are clearly identifiable in your video or photo, you warrant that you have obtained their permission to be filmed and shared.

4. Communication & Marketing Consent (SMS/MMS and Email)

By providing your phone number and/or email address in connection with your Submission, you expressly consent to receive recurring promotional, marketing, and informational communications from The Arcadian Wild and Arcadian Wild LLC.

  • Emails: You consent to receive email newsletters, tour announcements, and promotional offers. You can opt out at any time by clicking the "unsubscribe" link in any email.

  • SMS/MMS Text Messages: You consent to receive text messages (including automated text messages) regarding music releases, tour dates, merch, and special updates.

    • Message and data rates may apply.

    • Consent to receive marketing texts is not a condition of making a Submission or purchasing any goods or services.

    • You can opt out of text communications at any time by replying "STOP" to any text message received. For help, reply "HELP".

5. Privacy Policy & Data Collection

We respect your privacy. The information we collect from you (such as your name, email address, phone number, social media handles, and the media metadata) will be used to process your Submission, credit you if we choose to, and communicate with you as described in Section 4. We will not sell, rent, or lease your personal information to third parties. We may share your data with trusted third-party service providers (such as email marketing platforms or text messaging hosts) who assist us in operating our band business, under strict confidentiality terms.

6. Limitation of Liability & Indemnification

You agree to release, indemnify, defend, and hold harmless The Arcadian Wild, Arcadian Wild LLC, and their respective members, managers, employees, and agents from any and all claims, liabilities, damages, losses, or expenses (including attorney's fees) arising out of or in any way connected with: (a) our use of your Submission, or (b) your breach of any representation or warranty in this Agreement.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of Tennessee, without regard to its conflict of law principles.
